2. Contract Formation and Registration

We reserve the right to reject registrations without providing reasons. There is no entitlement to registration.

3. Scope of Services

• Access to a database with information about jumpscares in horror movies
• Ability to create and manage your own jumpscare entries
• Community features such as ratings and comments
• Notification functions during movie playback

We provide these services to the best of our knowledge and belief, but assume no warranty for completeness or accuracy of user-provided content.

4. User Obligations and Prohibited Actions

Users are obligated to:

• Provide truthful information during registration
• Keep access credentials confidential and report suspected misuse immediately
• Not publish illegal, offensive, or copyright-infringing content
• Not use automated systems (bots) to access the platform
• Not use the platform for commercial purposes without our express permission

Specifically prohibited: Distribution of malware, spam, hate speech, pornographic content, violation of personal rights or copyrights.

5. User Content and Copyright

By uploading content, you grant us the non-exclusive, worldwide, royalty-free right to use, store, process, and make publicly available such content within our platform.

You warrant that you have all necessary rights to the uploaded content. In case of copyright infringement, you are liable for all resulting damages and indemnify us against third-party claims.

We reserve the right to remove content without prior notice if it violates these Terms or applicable law.

6. Availability and Technical Requirements

We strive for the highest possible platform availability but cannot guarantee 100% availability. Maintenance work will be announced when possible.

Usage requires an internet-capable browser and stable internet connection. Internet connection costs are borne by the user.

7. Termination and Suspension

You may delete your user account at any time without providing reasons. We may suspend or delete your account for violations of these Terms or other important reasons.

Upon termination, your personal data will be deleted unless legal retention obligations exist. Content you created may remain on the platform in anonymized form.

8. Limitation of Liability

We are only liable for intent and gross negligence, as well as for breach of essential contractual obligations (cardinal duties). For simple negligence, liability is limited to typical, foreseeable damages.

Liability for damages resulting from injury to life, body, or health, as well as under product liability law, remains unaffected.

We assume no liability for third-party content, particularly user content. Use of jumpscare information is at your own risk.

9. Data Protection

Processing of personal data is carried out according to our Privacy Policy and GDPR provisions. Details can be found in our separate Privacy Policy.

10. Changes to Terms

We reserve the right to change these Terms at any time. Changes will be communicated via email or displayed at your next login. If you do not object within 4 weeks, the changes are deemed approved.

11. Dispute Resolution and Jurisdiction

All disputes arising from this contract are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is our registered office, provided you are a merchant, legal entity under public law, or special fund under public law.

12. Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions remains unaffected. Invalid provisions will be replaced by those that come closest to the economic purpose.
